In May 2018, the US Supreme Court ruled in favor of legal sports betting, allowing all states, including Delaware, to make up their own mind on the legalization of sports betting and what form it can take upon implementation.

The Supreme Court judgement came after a two-decade long battle between the state of New Jersey and the NCAA, NFL, MLB, NHL and the NBA. Ultimately, the Supreme Court ruled 7-2 that the Federal Law banning sports betting was unconstitutional and dismissed the law.

The legal decision has changed the U.S. Sports Betting Industry forever, and as sports gamblers, how we will access our gaming in the very near future.

Therefore, it is now legal to bet on sports in the United States. There is no ban disallowing any of the 50 states from establishing online sports books, if they choose to do so. However, any state can choose not to implement sports betting if they see fit.

Sports betting regulations are now made on a state-by-state basis, including Delaware.

For the time being, the only legal venues at which to do so in Delaware are at the State’s 3 land-based casinos.

In the future, however, you may be able to bet on sports anywhere within the state of Delaware.

Delaware Casino Gambling

In 1994, Delaware land-based casinos were legalized by the state legislature. Being one of the smallest states in the union, Delaware is probably more well known for its beaches than its casinos (there are currently 3) in operation.   • All sites may NOT OFFER contests based on amateur or college sporting events.
  • They must only accept customers over 18,
  • They must be subject to independent audits and;
  • They must keep players’ funds in a separate account from operator funds (in order to protect customers’ deposits).
  • Sunset clause – The Delaware law on DFS will be reviewed in 2019.

 Online Players have been able to play DFS online in Delaware for years prior to the 2017 state bill and little changed for players. The largest DFS sites applied for licenses immediately and all are currently authorized to continue holding DFS contests in Delaware.

How DFS works

Your team’s real-life counterparts amass stats (TDs, strikeouts, goals, points, completions, hits, rebounds etc.) in the real world and subsequently your fantasy league team accumulates points online. The person whose team accumulates the most points, wins the league be it a weekly, regular season, stand-alone playoff ‘league’ or competition.

Poker in Delaware

Whilst some types are gambling are actively encouraged in Delaware, unlicensed Poker and other forms of unlicensed games are not.
